How to Sell CBD on Shopify in 2026: Compliance, Payments, and Growth

Selling CBD on Shopify has never been straightforward — but 2026 brings a new level of complexity. The November 2025 federal hemp legislation rewrote the rules on THC limits and banned synthetic cannabinoids. Payment processing is still a minefield. Advertising restrictions haven't loosened. And the FDA still hasn't finalized formal CBD regulations.

Can You Still Sell CBD on Shopify in 2026?

Yes — but the requirements are specific. Shopify allows the sale of hemp-derived CBD products under these conditions:

  • Business location: Your business must be based in the United States or Canada.
  • THC compliance: Products must contain no more than 0.3% THC on a dry weight basis (or lower if required by your state).
  • Legal compliance: Products must be sourced, processed, tested, labeled, and marketed in compliance with all applicable federal, state, and local laws.
  • No health claims: You cannot market products as having medicinal or therapeutic benefits unless FDA-approved.
  • Documentation on demand: Shopify can request compliance documentation at any time — have your COAs and lab reports organized and accessible.
  • Third-party payment processing: Shopify Payments is still prohibited for CBD. This has not changed and is not expected to change.

Shopify has moved away from requiring a formal "Attestation for the Sale of Hemp and Hemp-Derived Products" form. Instead, merchants are now expected to comply with the terms on Shopify's hemp compliance page. The requirements are the same — the process is just less bureaucratic.

Canadian merchants can sell CBD on Shopify but must hold a proper cannabis license and operate on Shopify Plus.

The November 2025 Federal Hemp Legislation: What Changed

0.4mg Container Cap

Any final hemp-derived cannabinoid product cannot contain more than 0.4 milligrams of total THC per container. This is extremely low — most intoxicating hemp products currently on the market (edibles, beverages, vapes, oils) exceed this threshold. Even some full-spectrum CBD products with trace THC could be affected.

Synthetic Cannabinoid Ban

Products containing cannabinoids produced outside the plant — including delta-8 THC chemically converted from CBD — are explicitly prohibited. Delta-8, delta-10, HHC, and THCP are effectively banned at the federal level.

What This Means for CBD Sellers

The compliance deadline is November 12, 2026. Here's how to position your product line:

  • CBD isolate products: Best positioned. Zero THC, no compliance risk.
  • Broad-spectrum CBD (zero THC): Also well positioned, provided lab testing confirms no detectable THC.
  • Full-spectrum CBD: Needs reformulation assessment. Products with naturally occurring trace THC may exceed the 0.4mg container cap depending on serving size and concentration.
  • Delta-8, delta-10, HHC products: Must be removed from your catalog before the compliance deadline.

What CBD Products Can You Sell on Shopify?

Shopify permits hemp-derived products containing ≤0.3% THC (total THC under the new standard). Allowable product categories include:

  • Broad-spectrum and full-spectrum hemp products (within THC limits)
  • Topicals — lotions, balms, creams, skincare
